Dispute Assistance
Self Mediation
In the event of any dispute between you and another member (whether a Buyer or Service Provider) relating to a Project Deliverable, you can "Self Mediate" such dispute in good faith before Lime Labs for a period of seven business days.
Such 7-day period shall be deemed to have begun the day when you or another member requests for Dispute Assistance Services on LimeExchange. Either the Service Provider or Buyer can initiate the self mediation process.
To start the "Self Mediation" process, please visit your project details page and click the "Quick Links" panel on the left hand side. Click the "Assistance" link in the "Quick Links" panel. On the resulting page, select the project for which you are seeking mediation and fill in the online Self-Mediation Form.
Once you have started the mediation, the project enters "SELF MEDIATION" state and cannot be proceeded with until the dispute gets resolved. The project message board remains active for discussion between the disputing parties. After discussion, either of the disputing parties can propose a resolution by clicking the "Propose Resolution" link on the project details page and filling in the Self-Mediation Agreement Form.
The resolution proposed by you has to be agreed upon by the other party. In case both the parties agree, Lime Labs would be informed of the agreement and Lime Labs would make the necessary deductions/payments within 10 business days, and the project would then be closed.
In case the other party does not contest the proposed resolution within 7 business days of it being submitted, then the other party will be deemed to have agreed to the resolution proposed by the submitting party through the Self-Mediation Agreement Form. In such a case, Lime Labs will make the deductions/payments described in the Self-Mediation Agreement Form within 10 business days and the project will then be closed.
If the other party does contest the proposed resolution within 7 business days of it being submitted and no agreement is reached between the parties, then the dispute will automatically forward to Lime Labs and the Dispute Assistance Period will begin.
Dispute Assistance Period
In case no agreement is reached during the "Self Mediation" period, the dispute is forwarded to Lime Labs automatically after 7 business days from the start date of the self-mediation. Lime Labs would take another 7 business days to get the matter sorted out from the date such request gets forwarded to LimeExchange. During this 7-day period, LimeExchange would try to contact both the parties and schedule a conference call. This period of 7 days is known as Dispute Assistance Period.
If Lime Labs is able to facilitate a resolution acceptable to both the Service Provider and the Buyer, either Service Provider or Buyer will submit a Self-Mediation Agreement Form that accurately reflects the resolution mediated by Lime Labs, and Lime Labs will make the deductions/payments described in the Self-Mediation Agreement Form within 10 business days and the project will then be closed. Following the LimeExchange completion of deductions/payments, Lime Labs will close the project at issue. Where Lime Labs brings the parties to a resolution, neither party shall have the right to contest the Self-Mediation Agreement Form.
Arbitration
If a resolution has not been reached by the end of the Dispute Assistance Period and the Limitations Date has not expired, either party to a dispute has the right to submit the dispute for arbitration to a neutral Lime Labs assigned third-party dispute resolution service. If either party requests arbitration, all arbitration shall be settled in accordance with the rules of net-ARB.com (“Arbitrator”).
